General Terms and Conditions
Article 1 - Definitions
- "Novèra" refers to the online merchant, service provider, and user of these general terms and conditions.
- "Customer" refers to any natural person or legal entity who visits the website, places an order, or enters into a contractual agreement with Novèra.
- "Agreement" refers to any binding contract established between Novèra and the Customer regarding the purchase and delivery of products.
Article 2 - Applicability
- These terms and conditions apply to all product listings, offers, digital content, and legally binding agreements concluded between Novèra and the Customer.
- By accessing the website or completing a purchase, the Customer explicitly accepts these terms and conditions without reservation. Any deviations from these terms are only valid if explicitly agreed upon in writing by Novèra.
Article 3 - The Offer & Order Formation
- Validity of Offers: If an offer or promotion has a limited duration or is subject to specific conditions, this will be clearly stated on the product page.
- Pricing & Manifest Errors: All prices are displayed in GBP (£) and are inclusive of UK VAT (where applicable) unless stated otherwise. Novèra is not bound by obvious clerical errors, typos, pricing glitches, or manifest misprints in the webshop. In the event of a pricing error, Novèra reserves the right to cancel the order and issue a full refund.
- Stock Availability: All product offers are subject to availability. If a product becomes unavailable after an order is placed, Novèra will notify the Customer and provide an alternative solution or a full refund.
Article 4 - Payment & Security
- Payment Completion: The Customer must fulfill the payment using the secure, authorized payment methods provided during the checkout process (e.g., Credit/Debit Card, Apple Pay, Google Pay, or Klarna/Clearpay if applicable).
- Payment Failure: Novèra reserves the right to withhold shipping or suspend the fulfillment of an order if the payment method is declined, fraudulent, or cannot be fully verified.
Article 5 - Shipping, Delivery, and Risk Transfer
- Shipping Address: The Customer is responsible for providing a correct and complete UK delivery address. Any additional shipping costs incurred due to incorrect address details provided by the Customer will be charged to the Customer.
- Delivery Timeframes: Estimated delivery times are indicative. While Novèra strives to meet all delivery timelines, unexpected delays from courier services do not entitle the Customer to compensation unless legally mandated under UK consumer law.
- Risk of Loss: The risk of damage, loss, or theft of products passes to the Customer at the moment the package is successfully delivered to the provided address or a designated safe place/neighbour by the postal carrier.
Article 6 - Complaints, Liability & Consumer Rights
- Statutory Rights: Nothing in these terms affects your statutory rights under the UK Consumer Rights Act 2015 (products must be of satisfactory quality, fit for purpose, and as described).
- Reporting Timeline: Complaints regarding defective products, incorrect items, or the execution of the contract must be submitted fully, clearly described, and emailed to info@novera.com within a reasonable timeframe after discovering the issue.
- Evidence Required: To process a complaint efficiently, the Customer may be asked to provide clear photo or video evidence of the defect or damage.
- Limitation of Liability: Novèra’s liability is strictly limited to the purchase price of the specific product that caused the dispute. Novèra does not exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
Article 7 - Intellectual Property
- All text, product photography, logos, graphics, and digital layouts on this website are the exclusive intellectual property of Novèra. Any unauthorized reproduction, copying, distribution, or commercial reuse of these assets without explicit written consent from Novèra is strictly prohibited.
Article 8 - Governing Law & Disputes
- All agreements, transactions, and legal relations between Novèra and the Customer are exclusively governed by, construed, and enforced in accordance with the laws of England and Wales.
- Any disputes arising from or related to agreements between Novèra and the Customer that cannot be resolved through mutual consultation will be submitted to the exclusive jurisdiction of the courts of England and Wales.
